Re: Appointment of Independent Special Prosecutor to handle Criminal Cases Filed against Filipino Nurses and Their Lawyer (Indictment No. 00769A-K-07)



Dear Governor Spitzer:

  
We, the undersigned residents of New York, respectfully request your office to appoint a Special Prosecutor to oversee the criminal cases filed ten Filipino immigrant nurses and their lawyer. We strongly believe they were wrongly indicted by the Suffolk County District Attorney’s office.
 
The nurses used to work at Avalon Gardens, a facility managed by Sentosa Care. They resigned after they had filed discrimination charges against their respective contracting employers, which were other facilities managed by Sentosa Care. None of the ten had any employment contracts with Avalon Gardens. After resigned, Sentosa Care filed administrative cases and civil cases against the nurses. Almost a year after, and after the administrative cases were dismissed, and after the Supreme Court Justice hearing the civil cases denied Sentosa Care’s applications for preliminary injunction, D.A. Thomas Spota, upon Sentosa Care’s request, filed criminal charges against the ten nurses and their lawyer. Newsday’s investigative reports clearly detailed how Sentosa Care’s principals (Benjamin Landa and Bent Philipson) and their lawyers (Howard Fensterman) used their economic and political clout to retaliate against the nurses and their lawyer. They are major political campaign contributors and fundraisers to D.A. Spota and even Senator Schumer. We believe that the nurses’ and their lawyer’s indictments were a form of payback by Spota to his campaign contributors.

In this light, and to obviate any likelihood of partiality and unfairness to the defense of the nurses and their lawyer, we respectfully urge you to appoint an independent Special Prosecutor to handle the prosecution of these cases.
